Terms of Service

These Terms of Service ("Terms") govern your use of the Profile Construct mobile application ("App") developed by Aibek ("Developer", "we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or commercial purposes in accordance with these Terms.

2. App Description

Profile Construct is a mobile CAD application designed for:

• Creating window profile designs
• Calculating cost estimates
• Generating PDF reports
• Managing construction projects

3. User Accounts

The App may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. In-App Purchases and Subscriptions

The App offers premium features (ProfileConstruct PRO) through auto-renewable subscriptions on both iOS and Android platforms.

Subscription Options:

• iOS — Yearly Subscription: $29.99/year (price may vary by region and currency)
• Android — Yearly Subscription: $19.00/year (price may vary by region and currency)
• Free Trial (iOS only): A 7-day free trial may be available for eligible users. You will not be charged during the trial period. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

iOS Subscription Terms:

• Payment: Payment will be charged to your Apple ID account at the confirmation of purchase.
• Auto-Renewal: The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
• Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the current subscription price.
• Management: You can manage and cancel your subscription by going to your account settings on the App Store (Settings > [Your Name] > Subscriptions).

Android Subscription Terms:

• Payment: Payment is processed by Paddle (paddle.com), a third-party Merchant of Record. Paddle accepts credit/debit cards, PayPal, Google Pay, and other local payment methods.
• Auto-Renewal: The subscription automatically renews unless it is canceled before the end of the current period.
• Management: You can manage and cancel your subscription through the Paddle subscription portal. A "Manage Subscription" button is available inside the App.
• Receipts: Transaction receipts and renewal notifications are sent to the email address you provide during checkout.

5. Advertisements (Android)

On Android, the free version of the App displays advertisements provided by Google AdMob. These ads may include banner ads, interstitial ads, and app open ads. Subscribing to ProfileConstruct PRO removes all advertisements.

On iOS, the App does not display advertisements.

6. PRO Features

Free Features (both platforms):

• Create new projects
• Adjust material and labor prices

PRO Subscription provides:

• Access to saved projects (My Projects)
• Unlimited PDF and CAD export
• PRO user status

7. Refund Policy

iOS: Refunds for iOS purchases are handled according to Apple's App Store refund policy. To request a refund, visit reportaproblem.apple.com or contact Apple Support.

Android (Paddle): If you are not satisfied with your purchase or believe a transaction was unauthorized, you may request a refund by contacting us at mydevelopgroup@gmail.com within 30 days of the purchase date. Please include your email address used during checkout and a brief description of the reason for the refund. We will review your request and respond within 5 business days.

To dispute an unauthorized transaction on Android, please contact us immediately at mydevelopgroup@gmail.com with details of the transaction. We will investigate and resolve the dispute promptly.

8. Cancellation

You may cancel your subscription at any time. After cancellation, you will retain access to PRO features until the end of your current billing period. No further charges will be made after cancellation.

• iOS: Go to Settings > [Your Name] > Subscriptions > Profile Construct > Cancel Subscription.
• Android: Tap the "Manage Subscription" button in the App, then select "Cancel Subscription" to open the Paddle cancellation portal. Alternatively, contact us at mydevelopgroup@gmail.com.

9. Intellectual Property

The App, including its design, graphics, code, and content, is owned by the Developer and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Remove any copyright or proprietary notices
• Use the App for any unlawful purpose

10. User Content and Data Storage

You retain full ownership of any designs, cost estimates, and project data you create using the App.

• Local Storage: All project data and designs are stored locally on your mobile device. The App does not provide cloud synchronization or remote backup services.
• User Responsibility: You are solely responsible for the safety and backup of your data. We recommend regularly exporting your projects or using your device's system backup features (e.g., iCloud or Google Backup).
• Data Loss: The Developer is not liable for any loss of data resulting from App uninstallation, device failure, damage, or loss.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

13. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for violations of these Terms or for any other reason.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kyrgyzstan, without regard to conflict of law principles.
